David Markus, the lawyer representing Buju Banton, today moved a motion in the Sam M Gibbons federal court in Tampa, Florida to have the retrial postponed until February of next year.
Markus argument is that, a December trial would be bad for the defence, since Banton, 37, hopes to make arrangements to make bail for the holidays. Plus, a December trial date would have been bad for the defense attorney and witnesses. The government did not oppose the delay.
U.S. District Judge James Moody previous said Banton’s new trial would be in December, but he granted the defense motion to postpone it. Moody set the case for his February trial calendar but didn’t set a specific date.
last week U.S. Magistrate Anthony E. Porcelli approved the reggae artist security outfit, as well as, a house put up by fellow reggae artist Stephen Marley, paving the way for Gargamel to be release on bonds. But Assistant U.S. Attorney James Preston said he will appeal the ruling, thus preventing Buju from being released.
Buju Banton, whose real name is Mark Myrie, is accused of conspiring to buy cocaine from an undercover officer in Sarasota. He’s been held without bail since his arrest in December. He is now trying to get released from jail pending the retrial.
Gargamel (Buju Alias) previous trial ended in a mistrial in September after juries were unable to decide on a verdict.
Banton’s attorney says his client wants to spend the holiday season with his family.
